Stephenson Prevails With Arson Defense to Fire Loss Claim

In Davis v. Allstate Insurance Company, the United States District Court for the Southern District of Mississippi granted partial summary judgment to Allstate and dismissed the plaintiff’s bad faith and punitive damages claim. The plaintiff alleged that the carrier breached the insurance policy following a fire loss at a rental property. The claim was denied after a fire origin and cause investigator determined that the fire was intentionally set. The Court held that expert’s opinions were well-supported because there were multiple points of origin and laboratory analysis confirmed high levels of flammable liquids in the house.
