Diane Pumphrey and Casey Younger defended this Mississippi Tort Claims Act case where a pedestrian was struck by a police vehicle in Copiah County, Mississippi. They put on evidence that the police officer was not acting with reckless disregard when he hit a pedestrian who ran in front of his patrol car after he pulled out from a stop sign. The plaintiff alleged the officer was speeding and ran the stop sign. The court not only found that there was no reckless disregard, but also determined there was no evidence of the officer speeding or running the red light.
