Smith and Stephenson Win Another Workers Compensation Case

On January 2, 2013, the Mississippi Workers Compensation Commission reversed an award for benefits in Shope v. AMS Staff Leasing and Dallas National Insurance Company.  Leland Smith and Robert Stephenson represented the employer and carrier in the case.  The employee alleged that he injured his hand while opening a truck door.  Smith and Stephenson pointed out that the employee failed to report the injury for 1 1/2 months, had a pre-existing injury to his hand, and provided a false medical history to his treating physician.  The Commission concluded that the employee lacked credibility and failed to present sufficient medical evidence to support the element of proximate causation.  The Commission found that the claims is not compensable and awarded no benefits.
